Early repayment fees: what Polish law allows

Can the bank charge you for repaying early? For variable rates only in the first 3 years – and with limits. Here's the overview.

Polish law on mortgage credit limits what banks can charge when you repay early – in full (e.g. when refinancing) or in part.

Variable-rate loans

  • Banks may charge a fee only during the first 36 months of the loan.
  • The fee is capped at 3% of the amount repaid – and it cannot exceed the interest you would pay over one year.
  • After 3 years, repayment is free.

Fixed-rate loans

  • During the fixed-rate period, the bank may charge compensation for early repayment, according to the contract.
  • The compensation should reflect the bank's actual cost – check your agreement or ask the bank for the exact amount.

Many banks charge nothing

Many current offers have no early repayment fees at all. Check your agreement – look for "prowizja za wcześniejszą spłatę" or "rekompensata".

Why it matters

The fee is part of the cost of refinancing. If it's high, it might be worth waiting until the fee period ends.
