Do foreigners need a permit to buy property in Poland?

For a flat – usually not. For a house with land – often yes. A short overview of the rules for non-EU citizens.

Poland has a special law on the acquisition of real estate by foreigners. It mostly concerns citizens of countries outside the EU/EEA and Switzerland.

Buying a flat

Buying a separate residential unit (a flat) generally does not require a permit from the Ministry of the Interior. This is the most common situation for our clients.

Buying a house or land

Buying a house with land or a plot usually requires a permit from the Minister of the Interior and Administration. There are exceptions – for example for people who have lived in Poland for at least 5 years after obtaining a permanent residence permit.

Getting the permit takes time, so plan it before signing a preliminary agreement.

Citizens of the EU/EEA and Switzerland

They buy property on the same terms as Polish citizens – no permit needed.

Who checks this?

The notary verifies whether a permit is needed before the purchase deed is signed. If you are buying a house, ask the notary early.
